TERMS & CONDITIONS

The following General Terms and Conditions apply to all services, the provision of banquet rooms and the catering of MICEmunich Conny Schad, hereinafter referred to as "MICEmunich", for the performance of events and all related deliveries and services to the Client in the following: "Promoter". Conflicting conditions of the promoter do not apply.

1. Cancellation
If events in which food is served are canceled by the organizer up to 96 hours before the beginning of the event, the promoter has to pay 50% of the ordered menu price on the basis of the agreed number of participants. In case of later cancellation the full contract price acc. Number 4 to pay. Deviating from this, only the costs of provisioning will be charged in full for exhibitions and conferences, provided a cancellation is made no later than four weeks before the start of the event. The promoter reserves the right to prove less damage on the part of MICEmunich.

2. Becoming valid of the event contract
The reservation of rooms and areas, as well as the agreement of other deliveries and services shall become binding upon both parties upon written confirmation by MICEmunich.

3. Number of participants
For events where food is served, the promoter must specify the exact number of participants at least 4 working days before the event. These details are considered as guaranteed contract contents and are used as a minimum by MICEmunich of the final bill. Any further orders for food, drinks, tobacco products etc. will be charged separately according to the list prices of MICEmunich. In the event that the specified number of participants is exceeded by more than 5%, the MICEmunich must reserve the right to change the order of meals.

4. Prices and terms of payment
Our prices include service charge and all taxes excluding 19% VAT. At the conclusion of the contract, a deposit of 80% of the expected value of the contract is payable. Location and room rentals are 100 percent payable upon signing. The upfront payment amount must be transferred to the account of the MICEmunich at least 30 days before the start of the event. Invoices from MICEmunich must be paid within 10 days of the invoice date without deduction. Failure to comply with this clause, MICEmunich will charge 1 percent interest per month.

5. Beverage Billing
Unless otherwise agreed, drinks will be charged according to actual consumption.

6. Food and drinks brought
The promoter is not allowed to bring food and drinks to the events. In special cases, a written agreement can be made; In these cases, MICEmunich will charge an appropriate service fee or appropriate corkage.

7. Valuables
MICEmunich assumes no liability for any valuables, cash, textiles,clothes, musical instruments etc.

8. Liability
The promoter is liable for any loss or damage caused by his employees, other assistants or event participants, as well as losses or damage caused by himself. At the request of MICEmunich, the promoter must prove the conclusion of suitable liability insurance. In order to avoid damage to the walls, the attachment of decorative materials or other objects is permitted only with the written consent of MICEmunich. The promoter warrants that the decoration material in particular complies with the fire safety requirements. MICEmunich is only liable for loss or damage of objects brought in if it is at fault.

9. Technical facilities
Insofar as MICEmunich procures technical or other equipment from third parties for the performance of the event, MICEmunich acts on behalf of and for the account of the promoter. The promoter is liable for the careful handling and proper return of these facilities and releases the MICEmunich from all claims of third parties arising from the provision of the facility.

10. Termination by MICEmunich
MICEmunich is entitled at any time to terminate the contract if the event jeopardizes the reputation or security of the house or MICEmunich, or in case of force majeure or other good cause.

11. Music events
For music events and GEMA-obligatory music performances, the GEMA registration has to be done by the promoter.

12. Jurisdiction
If the organizer is a registered trader within the meaning of the Commercial Code or public corporation or does not have a general place of jurisdiction in Germany, the place of jurisdiction is Munich.

13. Final provisions
Should individual provisions of these general conditions for events be ineffective, this does not affect the validity of the above provisions. In place of the invalid provision, a valid provision which comes as close as possible to it applies. Deviating agreements or additional agreements must be made in writing in order to be valid.
